Terms of Service

By creating an account, starting a trial, subscribing, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of a company or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.

If you do not agree, do not use the Service. We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use after changes take effect constitutes acceptance.

The Service is operated by fuchka (“fuchka,” “we,” “us,” or “our”) and is available at tryfuchka.com. Questions about these Terms: operations@tryfuchka.com.

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of account information, safeguarding credentials, and all activity under your account. Notify us promptly of any unauthorized use.

You may sign in with email and password or with a supported third-party identity provider (such as Google). You must keep your login methods secure and disconnect integrations you no longer control.

fuchka helps solo founders and operators run intent-based LinkedIn outreach and related follow-up. Depending on your plan, features may include prospect import and enrichment, AI-assisted offering research and message drafting, multi-channel sequences (LinkedIn, email, WhatsApp), a unified inbox, credits for AI and enrichment usage, and related tools.

We may change, suspend, or discontinue features, plans, or the Service as a whole. We will use commercially reasonable efforts to avoid material disruption, but we do not guarantee uninterrupted or error-free operation.

The Service connects to third-party platforms and providers, including LinkedIn, email providers (such as Gmail and Outlook), WhatsApp, payment processors, enrichment providers, and AI model providers. Your use of those platforms remains subject to their terms and policies.

You are solely responsible for complying with LinkedIn’s and other platforms’ terms, including limits on messaging, automation, scraping, and connection activity. fuchka does not grant permission to violate third-party terms. We may suspend accounts that appear to create risk of platform bans, abuse, or legal exposure.

You agree not to:

• Use the Service for spam, harassment, fraud, phishing, or deceptive outreach
• Import, process, or message personal data without a lawful basis and any required notices or consents
• Attempt to bypass rate limits, security controls, billing, or access restrictions
• Reverse engineer, scrape, or interfere with the Service except as allowed by law
• Upload malware or content that infringes others’ rights
• Resell, sublicense, or provide the Service to third parties without our written consent
• Use the Service in any way that violates applicable law or third-party platform rules

You retain ownership of content you submit (“Customer Content”), including offering materials, instructions, drafts you approve, contacts, messages, and connected-account data you authorize us to process.

You grant us a worldwide, non-exclusive license to host, process, transmit, and display Customer Content solely to provide, secure, maintain, and improve the Service, and as otherwise described in our Privacy Policy. You represent that you have all rights and permissions needed to submit Customer Content and to message or store prospect information.

You are responsible for the accuracy and legality of outreach you send. AI-generated drafts are suggestions only — you remain responsible for what you approve and send.

New accounts may receive a free trial as described on our pricing page. Paid plans are billed in advance on a recurring basis through our payment processor. Prices, included credits, and feature entitlements are shown at checkout and in-product billing.

Credits power AI-assisted research, enrichment, scoring, drafting, and related usage. Unused subscription credits may roll over while your subscription remains active, as described in-product. Credits have no cash value and are non-transferable except as required by law.

You may cancel auto-renewal so your plan ends at the current billing period. Unless required by law or expressly stated otherwise, fees are non-refundable, including for unused credits or partial periods. Chargebacks or payment failures may result in suspension.

fuchka and its licensors own the Service, including software, designs, trademarks, and documentation. These Terms do not transfer any ownership rights to you. Feedback you provide may be used by us without obligation to you.

If either party shares non-public information marked or reasonably understood as confidential, the receiving party will use it only as needed under these Terms and protect it with reasonable care. This does not apply to information that is public, independently developed, or rightfully received from others without duty of confidentiality.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTREACH WILL PRODUCE MEETINGS, REVENUE, OR ANY PARTICULAR RESULT, OR THAT THIRD-PARTY PLATFORMS WILL CONTINUE TO ALLOW INTEGRATIONS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUCHKA AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

You will defend and indemnify fuchka against claims, damages, and expenses (including reasonable legal fees) arising from your Customer Content, your outreach, your violation of these Terms or law, or your misuse of third-party platforms.

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, create risk, fail to pay, or if we discontinue the Service. Upon termination, your right to use the Service ends. Provisions that by nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive.

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in Mumbai, Maharashtra, India will have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction to protect our rights.

These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements on that subject. If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices may be sent to your account email or posted in the Service.
